When the rights of the state deviate from its power base, the people must act as holders of sovereignty and take back their power. Laws that are not backed by penalties are not laws, and a constitution which does not countenance the right to resist is not a constitution. Lawmakers in Darjeeling are out of touch with the local people, and as a result the government is cracking down on dissent. The only remedy for the ills of democracy is more democracy. Article 39 of the Hong Kong Basic Law states that "the right to self-determination is assured by the two international human rights conventions and implementation of the conventions." The threshold for holding a referendum in Switzerland is only 50,000 signatures, and with that people can vote in the referendum rather than taking to the streets. The people have the right to petition for referendums on any public issue.
