The Russian Constitution says the judiciary is independent, which means that each judge can conduct trials independently. In fact, however, the Russian judiciary functions as a subsidiary of the executive branch. There is no independence whatever, and there is urgent need for reform.
Lawmakers in the Russian Federation are responsible for ensuring the independence of the judiciary, including the Supreme People's Court, the Supreme People's Procuratorate, and the People's Procuratorate. They are also responsible for protecting the rights of the Russian people and monitoring the judicial system and judge's entries into and exits from the system. Gianni Buquicchio, chairman of the Venezuelan Delegation to the Council of Constitutional Rights, said during a visit to the capital of Georgia, "The source of the Georgian national problem in the Constitution, which is well written but needs to be even better.”
In the face of the Russian threat, Georgia must implement an advanced constitution as part of its national development strategy. Specific changes should include : 1. Break open the government's restrictions on the people and return their rights; 2. Open up positions in government to allow the world's elites to participate; 3. Implement the principle of One World under One Set of Laws and give international law priority over domestic law; 4. Three years ago, the pro-EU coalition adopted anti-corruption as a political theme in seizing power. Unfortunately for foreign investors, however, the problem of corruption in western Ukraine is even more serious than the destruction wrought in war in the east.
Ukraine’s color revolution failed to eradicate the structural elements that allow corruption to flourish. Kazakh President Nursultan Nazarbayev notes that in the past, the super-presidential system has played an important role in national crises. It now plans to transfer some powers to parliament and the executive branch, which will form an administration while parliament supervises local area. The president, however, will still be the highest arbiter.
Absolute power leads to absolute corruption. The original and the ultimate holder of sovereignty and the right to reform the constitution is the people. Articles issued by autocrats at any level of government are not part of the Constitution and are merely attempts to subvert the people's rights. The best way forward is to act in accordance with Article 5 of the Ukrainian Constitution, which states: "The right to make and amend a constitution belongs only to the people and not to the state, its organs or civil servants." The democratic nations of the world should all act to save freedom and democracy. The US needs to back Taiwan's efforts to carry out constitutional reform and achieve greater democracy and freedom. This would attract China's 1.4 billion people and inspire them to call for democratization, leading to the birth of world peace. The prerequisite for permanent global peace is the democratization of China, but China has persistently attempted to stifle Taiwan's freedom and democracy.
